With the new ruling from ATF that they are no longer outside the norm for hunting, the state and this town in particular maybe in for an interesting case! If read correctly, this ruling means that they are no longer considered assault rifles! So the wording of our law might be considered a moot point!

All theoretical until a court case makes it so. Anyone want to fully finance a case taking this theory all the way to SCOTUS? I thought so.

What are they charging him with? possession of a banned firearm?  Where is the proof they are his? A Friend brought them in so the friend was in possession of them.  All he has to do is say they are not his.  Depending on when it was purchased there might not be a record of him buying it.

Dps3 I bet. There is always the risk they run those records against the registration records

I'd say there's clearly more to the story of why they were turned in.

Anybody know what the consequences this guy is going to face now that he was arrested with a weapon defined under the AWB and 13 High Capacity mags?

(68 years old, no prior arrests, and only 5k bail)

It's a class D felony, minimum of one year in prison for the AW. However, there is You are not allowed to view links. Register or Login for first time offenders: "....except that a first-time violation of this subsection shall be a class A misdemeanor if (1) the person presents proof that such person lawfully possessed the assault weapon (A) prior to October 1, 1993, with respect to an assault weapon described in subparagraph (A) of subdivision (1) of section 53-202a, or (B) on April 4, 2013, under the provisions of sections 53-202a to 53-202k, inclusive, in effect on January 1, 2013, with respect to an assault weapon described in any provision of subparagraphs (B) to (F), inclusive, of subdivision (1) of section 53-202a, and (2) the person has otherwise possessed the assault weapon in compliance with subsection (f) of section 53-202d."
