The latter.  You can slap any upper on it so long as the barrel is over 12in.   ;D

Wow. So I'm guessing you guys picked the 12.5" setup to keep the SBR feel without the SBR?  :laugh:  As ridiculously arbitrary as all these new rules are, I'm glad that I can at least re-use some previous investments and bring some parts back into the state safely.

I'm understanding from all this that as long as I don't have an unregistered lower (state or federal) with additional parts that I could then assemble into a full-stock AR, I'm safe with the AOW designation, assuming there's always a 12"+ barrel in play?

Yup.  Having the parts to make an AW is considered to be 'constructive possession' of an AW.
