Hense the reason he set up the rma and it had to stay in his name.

Which then unfortunately put you at his, and or Aimpoint's mercy.

One issue that isn't clear from the email trail (which is hard to follow), did you put YOUR address as the return address when you shipped the sight to Aimpoint? It appears at least twice the seller indicated that you had to put your address as the "return address". Did you include any kind of a document inside the returned package explaining what was wrong with it, and why you wanted it shipped to your address rather than the seller's address? It isn't clear what happened when the seller called to setup the RMA. I assume he used his address as the return address either by accident or otherwise, which is why Aimpoint sent it back to him rather than the buyer.

I put the information he told me to.
My name phone number email , address and rma. However when he called in and set up the rma they took all his details which was attached to the rma he had set up before I bought it. I was concerned if I pushed it aimpoint would say sorry your not the original purchaser.  When I told him everything was connected to him he said he would step up if the was anything he could do,,,  guess not.

IMO he agreed to refund you the money... so that should be what happens if you don't getthe scope...

People are funny, on all forums.

From my reading, my better judgement says he got a nice new optic that is now worth more than 250$ or at least worth more than 250$ to him. He is willing (or will at some point be willing) to refund you to make this all "go away" and keep his nice new optic. But he isnt willing to commit fraud by filing a false insurance claim because he knows they will investigate (minimally anyways, speak to delivery guy, talk to neighbors, etc...).

If he ends up filing an insurance claim I would say hes salvaged some of his honesty, though we will never know for sure if it was to cover his tracks or if it was legit. Him saying things like "I dont want to deal with it" just further everyones perception of dishonesty.

^^^ I cant think of anyone who would refund someone 250$ and not file an insurance claim to gain that back and more just because they didnt want to "deal with the hassle". Unless this guy has loads of cash and that kind of money is a drop in the bucket he has nothing to lose and everything to gain.

Again my prediction is he will refund your initial purchase price to keep you quiet and not file an insurance claim.

Edit: was it UPS or USPS that delivered the product. They both generally suck at basically everything, but sometimes there is a signature confirmation, might want to look into that. Also, it might work to his advantage if he explains that in the past these companies have delivered "across the street", but I also suspect that is bullshit. If that was normal practice, you can bet I would get on on them to correct it, and even then, if I knew (assuming you informed him a package was being sent to him) to expect a $400+ optic on a certain day, I would be a dog in the window waiting for that brown truck or white mutant golf cart to drive by.

I'd do that for 250 any day... if you get it back its all good, and you can still badmouth his dishonesty and insist not doing business with him again, while giving others fair warning.

If the seller really did receive the optic from UPS and then lied by saying he didn't then he's a scumbag. However, unless there is a UPS claim file and investigated, or some other forum member see's him using it, there is no way to know for sure if he lied or really didn't recieve it.

Since you asked for a refund early on it looks like the dispute had reached its conclusion providing the money is refunded. And your getting a possible bonus of additional monies. Looks like you too have benefited from this dispute.

As  much as the seller might be a bad guy here, you were trying to circumvent the Aimpoint warranty restrictions by having the optic fixed under his name since he was the original purchaser, rather than paying yourself for repair of the optic after the seller sold and delivered it to you.
