FFL Preban Transfer

Hoping someone might be able to clarify...

I purchased a preban lower receiver from out of state. PWA Commando with 4 Digit Serial Number. 

Made arrangements with FFL. The lower arrived today and he advised me that he cannot do the transfer because it has an adjustable stock on it.

He said either he can remove the stock or call DPS for clearance.

My thought is if he makes the call, they will just say not good which I suspect is the default response.

Any thoughts on how best to handle?

Tell your FFL to read the CT general statute, specifically this section:

Sec. 53-202m. Circumstances when assault weapons exempt from limitations on transfers and registration requirements. Notwithstanding any provision of the general statutes, sections 53-202a to 53-202l, inclusive, shall not be construed to limit the transfer or require the registration of an assault weapon as defined in subdivision (3) or (4) of subsection (a) of section 53-202a, provided such firearm was legally manufactured prior to September 13, 1994.

That PWA lower was manufactured FAR before 9.13.94.  Therefore, it is excempt from limitations on transfers.  It can transfer to you with a collapsible stock all day long.

Who is your FFL and why does he not know this?

You can get email confirmation from LMT on the date of birth, or ask him to send it to another FFL  or just have him undo the stock.

Bottom line is as an FFL in CT he should know better. It sounds like you know your prebans, but he needs to know the rules.

Thanks! Was really excited and of course this has put a damper on things.

I've used Joel Cramer to do transfers in the past and he is super! Being down in Stamford though it's a bit of a hike to get to him. Lesson learnt though, I'll continue to use Joel in the future!

I spoke to three FFLs who gave me three different excuses/roadblocks to transferring a pre-ban before I found Joel Cramer. 
These guys refused to accept the transfer even if it came as a stripped lower, without a stock.
